Butler also testified that similar injuries-the kind of which Mr. Barbarin’s disc injuries were related to the subject accident, and that he did not find any objective signs of injury. Butler testified that in his opinion, none of Mr. Barbarin that his damages did not exceed $50,000, a non-jury trial commenced on May 10, 2004. James Butler, an orthopaedist, who later testified as a defense expert. Pribil also placed a 25 to 26% whole body impairment rating on Mr. Barbarin was asymptomatic for lumbar injuries prior to the accident, it was his medical opinion that the lumbar disc injuries were attributable to the subject accident. Pribil opined that the cervical disc injury was an exacerbation from a previous injury. Barbarin as having a herniated lumbar disc at the L5/S1 levels, a protrusion at the L4/5 levels, and a cervical disc herniation at the C6/7 levels. Stefan Pribil, a board certified neurosurgeon, about thirteen months following his last doctor’s appointment, with complaints of neck and back pain. In his Petition, he alleged that as a result of the accident, he “sustained severe personal injuries to the mind and body including but not limited to the neck, back, head, spine, shoulders and knee for which he was forced to seek medical treatment.” On August 26, 2003, he presented to Dr. Barbarin filed suit in Orleans Parish Civil District Court on September 9, 2002. Friedman recommended additional physical therapy and referred Mr. Barbarin exhibited cervical muscle spasms. Aaron Friedman, a neurologist, on July 3, 2002. Following a cervical MRI on April 23, 2002, Mr. Altman’s care until April 5, 2002, at which time he was discharged. Altman with complaints of neck, back, shoulder, and knee pain along with headaches.
